ClutchCast — Terms & Conditions

PLEASE READ THESE TERMS CAREFULLY BEFORE USING CLUTCHCAST.

These Terms & Conditions (“Terms”) govern your access to and use of ClutchCast, including its website, applications, creator coins, NFTs, bonding-curve purchasing, staking, leaderboards, token-gated utilities, and other related services (collectively, the “Platform”). By creating an account, connecting a wallet, or using any part of the Platform, you agree to be bound by these Terms. If you do not agree, do not access or use ClutchCast.

1. Eligibility

You may use the Platform only if:

  • You are at least 18 years old, or the legal age of majority in your jurisdiction.
  • You have full authority to accept these Terms.
  • Your use complies with all applicable laws, including crypto regulations in your country.

We reserve the right to restrict or block access in regions where digital assets or Web3 activities are limited or prohibited.

2. Description of the Platform

ClutchCast provides tools and features including, but not limited to:

  • Creator Coins priced via bonding-curve mechanics
  • Fan engagement utilities (token-gated content, leaderboards, staking)
  • NFT minting, purchase, and redemption
  • Wallet-based sign-in and analytics dashboards

The Platform does not custody your private keys or funds. All on-chain transactions are executed via third-party wallets (e.g., MetaMask, Phantom, WalletConnect).

3. Not Financial Advice

ClutchCast is not a financial institution and does not provide investment, legal, tax, or financial advice. Creator Coins and digital assets listed on the Platform do not represent equity, ownership, revenue rights, or financial guarantees. Token prices are volatile; use the Platform at your own risk.

4. Wallets & Security

You are solely responsible for:

  • Maintaining control of your private keys and seed phrases
  • Securing access to your wallet and devices
  • Verifying transaction details before confirming

ClutchCast cannot recover lost private keys, reverse blockchain transactions, or access your funds.

5. Creator Coins

Creator Coins are digital tokens issued on the Platform and typically priced using bonding curves. They may confer utility as specified by the creator or the Platform but do not guarantee financial returns.

ClutchCast may adjust parameters, fees, or availability for platform integrity or legal reasons.

6. NFTs & Digital Collectibles

When you mint or purchase an NFT on ClutchCast, you receive the token as recorded on-chain and a limited license to use the associated digital asset as described by the creator. Unless explicitly stated, creators retain intellectual property rights.

7. Creator Responsibilities

Creators who publish content or utilities on ClutchCast must ensure that:

  • Content is original and lawful
  • They hold rights to any uploaded media
  • Promised utilities (e.g., gated content, livestreams, rewards) are delivered

ClutchCast may remove or suspend creator accounts for violations.

8. Platform Fees

ClutchCast may charge fees for various services, including bonding-curve transactions, NFT minting, staking, premium features, and withdrawal processing. All applicable fees will be displayed at transaction time.

9. User Conduct

When using the Platform, you must not:

  • Engage in fraud, wash trading, or market manipulation
  • Use bots or automated scripts to unfairly interact with listings
  • Upload unlawful, infringing, or harmful content
  • Attempt to exploit or reverse-engineer the Platform

Violations may lead to suspension, monetary penalties, or permanent bans.

10. Risk Acknowledgement

You acknowledge and accept risks including:

  • Price volatility and potential loss of value
  • Permanent and irreversible nature of blockchain transactions
  • Smart contract bugs, exploits, or network-level vulnerabilities
  • Third-party service outages or failures

11. Third-Party Services

The Platform integrates with third-party technologies (wallets, explorers, storage providers, payment processors). ClutchCast is not responsible for the availability, security, or performance of these services.

12. Intellectual Property

All ClutchCast branding, UI, source code, documentation, and other proprietary materials are owned by ClutchCast. You may not reproduce or redistribute platform assets without written permission.

13. Termination

ClutchCast reserves the right to suspend or terminate accounts for violations, suspected fraud, legal orders, or threats to platform integrity. Users may delete their accounts at any time, but blockchain transactions already executed remain immutable.

14. Disclaimers

The Platform is provided “as is” and “as available.” ClutchCast disclaims all warranties to the maximum extent permitted by law, including uninterrupted access, bug-free operations, or guaranteed accuracy of market data.

15. Limitation of Liability

To the fullest extent permitted by law, ClutchCast and its affiliates are not liable for lost funds, lost profits, damages from smart contract vulnerabilities, token volatility, hacks, or third-party failures. Your sole remedy for dissatisfaction is to stop using the Platform.

16. Changes to Terms

ClutchCast may update these Terms periodically. Continued use of the Platform after changes indicates your acceptance of the updated Terms. Material changes will be communicated via the Platform or email where reasonable.
